American Idol contestant sued by producers

Josiah Leming, who despite being a hit with viewers on last season’s American Idol, didn’t make the top 24, is now being threatened with legal action by the producers. Leming, 19, has a record deal with Warner Bros., but because all contestants have to sign contracts promising to record only with Sony/BMG, he may be sued. Leming is the contestant who was living out of his car and wrote his own compositions. Although amazing when performing his own stuff, he lacked the skill to sing other song choices and was shown crying on several occasions. Simon Cowell eventually decided not to put Josiah through because he didn’t feel had the maturity and self-control at that point in time to be able to emotionally handle success. However, Leming is determined to release his debut album because his mother is dying. His rep told “His mother has terminal cancer, and nothing is going to stop him from getting his music out while she is alive to share it. His album on Warner Records will be released in late January ’09.”  Leming is the only Idol contestant to get a record deal despite not making the top 24, and one of only four contestants (the others are David Archuleta, David Cook and Kristy Lee Cook) to get a deal this year.

    Well, I’m sure the contract is not FOR LIFE!! He didn’t even make the top 24! Once they get voted out, if they are not in the top 10 and offered a recording contract, then the contract they signed at the beginning should be null and void. I’m sure any judge would laugh at Sony/BMG if they proceed with this. Sony/BMG didn’t offer him a recording contract after he was voted out (probably because they were too interested in the top 5-10 AI contestants). Warner Bros. offered him a recording contract instead, and he was smart to take it as Sony would probably have made him wait a few years AT LEAST, while they went ahead with the more popular singers. But anyways, good luck trying to beat Warner Bros. there Sony!!

    Anyway, I read your first comment Nancy, and totally agree, Sony would probably have never given him a record deal anyway, I think they should all sign the contract when getting into American Idol, but if they don’t make, say, the top 5 or something, then they should be free agents.
    Sam, probably most people don’t really care, but I do like this guy, I liked him right from his audition, although he cries way too much for my liking. I think he’s like a very cute little boy, but has an amazing voice.
    NASIR, me too, I’ll be buying his cd for sure.

    The contract is for first right of refusal, you can’t sign someone to an exclusive contract if you don’t actually give them a contract. Sony is, as usual, being evil and obnoxious.

    They might have a claim on the album if it can be shown that A it was never offered to them (and they refused) and that B they want it now. Of course, I think that NOT getting into the final 24 is kind of a contract refusal by default since normally anyone NOT in the top 5 or 6 doesn’t get an offer of any kind.

    Well, good luck to her, but she’s not gonna find any. I know some places can track things to a certain area, or even to particular computer, but they can’t track to a particular person. That’s why I’ve always thought tribute should have some kind of login system like other sites have, but when I suggested it they had reasons not to. I think it would be good protection (of sorts) for us all.
