“The Hangover Part II” facing second lawsuit

French fashion house Louis Vuitton has slapped Warner Bros. with a hefty trademark suit for using a knockoff version of a Louis Vuitton bag in their film The Hangover Part II. In the scene, Zach Galifianakis’s character, Alan, wrongly identifies a handbag as one of their own but rather than using an authentic Louis Vuitton product, producers opted for a look-alike, presumably as a cheaper alternative because an authentic bag like the one shown in the film easily retails for over $1,000 USD. The label is arguing that it’s been damaged by Alan’s line in the film, “Careful, that is a Louis Vuitton”, which has become a catchphrase of sorts. They are thus claiming trademark dilution, false designation of origin and unfair competition. They’re also seeking a share of the film’s profits and for the the scene to be altered in the DVD version, to which Warner Bros. has refused.

This isn’t the first time the film has faced legal trouble. Earlier this year, tattoo artist S. Victor Whitmill, who created Mike Tyson’s unique face tattoo, also sued Warner Bros. for replicating the design on Ed Helms’s character in the film.  The studio ended up settling with Whitmill and agreed to digitally alter the design of the tattoo for the DVD release.

    really?
    with all the injustices in the world, this is what will take up court time. i hope the judge puts the bag maker out of business for using the system to advertise it’s product. this is border line contempt
