Kevin Hart says woman injured by his bodyguards is at fault

Kevin Hart in The Upside. Photo by David Lee/Weinstein CompanyKevin Hart blames a woman who claims to have been seriously injured when she was knocked down by his bodyguards while walking on a New York sidewalk, saying she should have known “the hazard.”

The court papers go on to say: “The injuries alleged to have been sustained by the plaintiff were sustained while [s]he was involved in an activity into which [s]he had entered, knowing full well the hazard thereof.”

Carmen Marrero, whose eye socket was broken in the fall, says she was walking past a building where Hart’s film The Upside was screening when Hart and his security guards came rushing out and slammed into her, knocking her to the ground.

Hart’s lawyers say in the court papers that the incident was “strictly caused by the provocation of the plaintiff [Marrero] and not by any act of the defendant [Hart].”

Marrero’s lawyer, Richard Russo, said: “It’s a defense as old as time. Blame the victim. When you walk the streets of New York you don’t assume the risk that an overzealous bodyguard will throw you to the ground and break your face.” ~Alexandra Heilbron

What a jerk. He wants people to feel sorry for him when he gets injured in a car crash because he didn’t wear a seatbelt but when he causes injury to an innocent bystander, he says it was her fault?

I agree with you totally Marsi. Sounds like a real nasty guy. They should have paid out of courts but now I hope this woman is able to sue their butts off. Lost all respect for this guy and his “guards”. Bunch of clowns. Poor woman!

Too many holes in this story. Was there a perimeter near the building restricting access to the public? If so, the bodyguards’ actions were adequate. If not, and there was no provocation from this lady, then they were out of order.

Send him to the cleaners, please!

That little bit of a man was lucky he wasnt killed in his car crash. Now he’s so thankful he survived he’s going get his big dollar lawyers and shove it straight up the ass of an innocent citizen just passing by. I hope the good Lord is paying attention to this and that all of a sudden suffers a stroke or a brain aneurism. I hope pay back is a bitch.

Was adequate warning posted by the filming company to the public? Was the victim ignoring adequate warnings? Either way, K. Hart could have been more sensitive in his statement. He seems to set an adversarial tone, to begin with. That may or may not be true either. Perhaps the woman/victim came out swinging? Lots of unanswered questions here.

Hart is one of those celebrities that needs to be reminded just how close he is to the D-List and who pays his salary … boycott his films make him responsible for his actions and those of his employees.

Where are all the facts? Mr. Hart has never been shy about expressing himself in public…sometimes in a harsh way, but I don’t know all the facts of this incident…poor reporting!

  14. Bwiser • November 25, 2019 @ 1:02 PM

    1. The movies was filmed in 2016 and released in 2017
    2. All reporting isn’t always accurate or factual
    3. Because Mr.Hart has a tendency to be vocal his PR would have provided a statement.
    4. Why is it necessary for us to respond in such a hostile way when all we have to go off is the “opinion” of a reporter. Also when have we not spoken out of term . Why are movie stars athletes musicians held to a different moral standard then any one else.

  15. Marsi • November 26, 2019 @ 9:37 AM

The movie was released in 2018. Click on the link. Those of you citing poor reporting, might want to get your own facts straight. And what opinion is expressed in this report or any others about this story? I see the lawyer giving an opinion, but not the reporter.

definitely need more details before can properly comment. \bodyguards job is to protect Kevin Hart. did she trespass in area that was clearly marked as area \”do not enter” if yes, than she paid the consequences. was she an innocent bystander and over zealous bodyguards than that iis a different situation. it is all in the missing details!!!
