Tracy Morgan Tracy Morgan's condition has been upgraded to fair. The 30 Rock star sustained a number of injuries - including a broken femur, a broken nose and broken ribs - when a Walmart truck smashed into the limo bus he was travelling in on the New Jersey Turnpike on June 7, but has made strong signs of improvement and is no longer in a critical condition. His representative said: ''He has been upgraded to fair condition, which is a great improvement. His personality is certainly starting to come back as well.'' Tracy's assistant Jeffrey Millea was also seriously injured in the crash, but the comic's representative confirmed his condition has also been upgraded to fair. The collision killed a fellow passenger, comedian James McNair, who performed under the name Jimmy Mack, while comedians Ardie Fuqua and Harris Stanton were also injured. Kevin Roper, the truck driver involved in the crash, has been charged with one count of death by auto and four counts of assault by auto in connection with the crash, but pleaded not guilty during an appearance at Middlesex County Superior Court in New Jersey last week. Following the hearing, Mr. Roper, 35, was released on $50,000 bail.
